1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the website workcoverhub.com.au and any associated services, forms, or communications (collectively referred to as the “Platform”), operated by Work Cover Doctors Australia Pty Ltd (ABN 59 683 397 506) trading as WorkCover Hub (“WorkCover Hub”, “we”, “us”, or “our”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
2. Nature of Services
WorkCover Hub is a coordination and referral platform. We provide general information relating to WorkCover, CTP, and related injury management processes in Australia and facilitate connections between users and independent third-party service providers, including medical practitioners, allied health professionals, legal representatives, and related professionals (“Service Providers”).
WorkCover Hub does not itself provide medical, legal, or allied health services. Any professional advice, diagnosis, treatment, or representation is provided solely by the Service Provider to whom you are referred. WorkCover Hub does not employ, manage, or control these Service Providers and is not responsible for their actions, omissions, or advice.
3. Eligibility for Use
By using the Platform, you represent and warrant that: – You are at least 18 years of age, or are using the Platform under the supervision of a parent or guardian; – You are legally capable of entering into binding agreements; and – All information provided by you is accurate, complete, and not misleading.
We reserve the right to suspend or terminate access if we reasonably believe these conditions are not met.
4. User Obligations
You agree to: – Provide accurate and complete information when submitting any form or enquiry; – Use the Platform only for lawful purposes and in compliance with these Terms; – Not impersonate another person or misrepresent your identity; – Not interfere with the operation or security of the Platform; and – Not use the Platform to transmit or distribute viruses, malware, or any other harmful material.
5. No Professional Relationship
Submission of an enquiry or communication through the Platform does not establish a doctor–patient, lawyer–client, or any other professional relationship between you and WorkCover Hub. Any engagement for professional services occurs directly between you and the relevant Service Provider, under terms agreed between you and that provider.
6. Referrals and Third-Party Providers
WorkCover Hub may, with your consent, refer your information to independent Service Providers for the purpose of facilitating contact and service delivery.
We do not guarantee that a Service Provider will accept your case or that any particular outcome will result. Service Providers are independent professionals responsible for their own conduct, licensing, and compliance.
WorkCover Hub is not liable for the quality, timing, accuracy, or outcome of services delivered by any Service Provider.
7. Fees and Payments
Use of the Platform is generally free to users. Any payments for medical, legal, or allied health services are made directly between you and the Service Provider in accordance with their own terms.
8. Intellectual Property
All intellectual property rights in the Platform, including its design, text, graphics, layout, software, and other content, are owned or licensed by WorkCover Hub.
You may access and view the Platform for personal use only. You must not reproduce, modify, distribute, display, or otherwise use any material from the Platform without our prior written consent.
9. Disclaimer and Limitation of Liability
The Platform and its content are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law: – WorkCover Hub makes no representations or warranties about the accuracy, reliability, completeness, or suitability of any information or materials provided; – We do not warrant that the Platform will be error-free, secure, or uninterrupted; – We exclude all liability for any loss, injury, damage, or expense arising out of or in connection with your use of the Platform, including reliance on any information provided therein.
Nothing in these Terms excludes, restricts, or modifies any statutory right or guarantee that cannot lawfully be excluded under the Australian Consumer Law (ACL).
10. Indemnity
You agree to indemnify and hold harmless WorkCover Hub, its directors, employees, and contractors from and against all claims, losses, damages, liabilities, costs, or expenses (including legal costs) arising from your use of the Platform, your breach of these Terms, or your violation of any law or third-party rights.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, store, use, and disclose your personal information in accordance with the Privacy Act 1988 (Cth). By using the Platform, you consent to our handling of your personal information in accordance with that Policy.
12. Availability and Maintenance
We may modify, suspend, or discontinue the Platform or any part of it at any time without prior notice. We will not be liable if the Platform becomes unavailable for any reason, including maintenance or system failure.
13. Termination
We may, at our discretion, suspend or terminate your access to the Platform without notice if we reasonably believe you have breached these Terms or engaged in conduct detrimental to our operations or reputation.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Amendments
We may amend these Terms at any time by publishing an updated version on our website. The amended Terms take effect immediately upon publication. Continued use of the Platform constitutes your acceptance of any changes.
